1. Acceptance of Terms

By visiting our website at www.pellegrinomusic.com, purchasing products or services, renting instruments, enrolling in music lessons, or otherwise engaging with Pellegrino Music Center ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of our site and services.

2. Products and Services

We offer the following products and services:

•      New and used musical instrument sales

•      Instrument rental programs

•      Music lessons (individual and group)

•      Instrument repair and maintenance

•      Sheet music, accessories, and gifts

•      Audio, visual and lighting integration

All sales are subject to availability. Prices are subject to change without notice. We reserve the right to refuse service to anyone for any reason.

3. Instrument Rental Program

Instrument rentals are governed by a separate Rental Agreement signed at the time of rental. Key terms include:

•      Rental fees are due on the schedule specified in your Rental Agreement

•      Instruments must be returned in the same condition as rented, subject to normal wear and tear

•      You are responsible for loss, theft, or damage beyond normal wear

•      Rental credits may be applied toward purchase as outlined in your Rental Agreement

4. Music Lessons

Music lesson scheduling, cancellation, and payment policies are established at the time of enrollment. General terms include:

•      Lesson fees are due as specified at enrollment

•      Cancellations require advance notice as specified in your enrollment agreement

•      We reserve the right to substitute instructors when necessary

•      For students under 18, a parent or guardian must authorize enrollment

5. SMS Marketing Communications

Pellegrino Music Center's SMS marketing solution is powered by BluStream and is used to improve your shopping and service experience. By consenting to Pellegrino Music Center's SMS marketing (via our opt-in form, rental contract, or in-store/verbal consent) you agree to receive recurring text notifications, including:

•      Text marketing offers, promotions, and product announcements

•      Transactional messages such as rental reminders and order updates

•      Educational content including product tips, setup guides, usage tips, and maintenance information

•      Product recommendations and review requests

These messages may be sent even if your mobile number is registered on any state or federal Do Not Call list. Message frequency varies. Consent is not a condition of purchase.

To opt out: Reply STOP to any message at any time. We may send a one-time confirmation.

For help: Reply HELP to any message, or contact us at the information in Section 11.

We do not charge for the SMS service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Standard message and data rates may apply.

We reserve the right to modify the telephone number or short code used to operate the SMS service at any time, with notice to you. You agree that any messages (including STOP or HELP requests) sent to a changed number may not be received, and we will not be liable for honoring such requests.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS service, any errors in such information, or any action you may or may not take in reliance on the information. You agree that the telephone number you provided is yours, and if it changes, you must notify us with your new number.

6. Payments

We accept major credit cards and other payment methods as displayed at the time of purchase. All transactions are processed securely through our third-party payment processor. We do not store full credit card numbers.

7. Intellectual Property

All content on our website, including text, images, logos, and graphics, is the property of Pellegrino Music Center or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Pellegrino Music Center shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of our services, website, or products. Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Stark County, Ohio.

10. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms. The "Last Updated" date at the top of this page will reflect the most recent revision.
